Trade Promotion – Game of Chance – 2022 WMD Pre-Registration Competition

Promotion details

    1. Information on how to enter forms part of the terms and conditions. Participation in this pre-registration promotion (“Promotion”) is deemed acceptance of these Terms and Conditions.
    2. This promotion commences on 12.01 AM AEDT Monday 31st January 2022 and closes at 11:59 PM AEDT on Thursday 24th February 2022 (“Promotional Period”).

 

How to enter

    1. Entry is only open to entrants employed by schools or parents of students. To be eligible to enter, an entrant must:
      (a) aged 18 years or over; and
      (b) complete their first name, last name, email address, and registration responses on World Math(s) Day Pre-Registration Page;
      (c) not have a current school or home user subscription to Mathletics at the time of registration; and
      (d) if applicable, authorised to act on behalf of their school during the Promotional Period.
    2. An entrant who submits the draw will be eligible for the chance to win 1 of 3
      USD $250 (excl. GST) gift vouchers with a retailer or issuer that is selected by the Promoter in their sole discretion, subject to relevant law.
    3. Only one entry per entrant will be accepted.
    4. Prizes will be awarded to 3 entrants selected at random from a prize draw. The winning entrants must pre-register their child or class to participate in World Maths Day by 11:59 PM AEDT Thursday 24th February 2022 to be eligible.
    5. The following people or entities are ineligible to enter the Promotion: Directors and employees of the Promoter Group, and each of their immediate Family Members (refer to definitions further below).
    6. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any entrant who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
    7. If there is a dispute as to the identity of an entrant or the entrant’s capacity to represent their school, the Promoter reserves the right, in its sole discretion, to determine the identity and the capacity of the entrant. The Promoter’s determination is final.

 

Winners draw dates

    1. Winners will be drawn at the Promoter’s office at 3P Learning Ltd, 655 Parramatta rd, Leichhardt, NSW 2040 (or via a remote location in the event of COVID-19 restrictions) on Monday 28th of February 2022 at 3:00 PM AEDT.

 

Winners draw criteria

    1. The Competition is a Game of Chance. Each valid entry will be entered into the draw and winners will be selected at random.

 

Prizes

    1. The 3 drawn winners will be awarded a gift voucher, each valued at USD $250 for a retailer or issuer that is selected by the Promoter in their sole discretion and subject to law. The retailer will be selected from Mastercard, Visa or another retailer based on the territory of the winner, and notified to the winner. The Promoter’s decision is final.
    2. There are 3 prizes in total. The minimum total prize pool is USD $750 (excl. GST). All prizes are non-transferable or non-redeemable for cash and must be taken as offered.
    3. The winners agree to accept and abide by the terms and conditions of the gift vouchers.

 

Notification of winners

    1. Winners will be notified by email by Friday 4th March 2022.
    2. The names of the winners will be published on the Mathletics website from Friday 4th March 2022 to Monday 4th April 2022.
    3. The winner is deemed not to claim the prize, and to return the prize for redraw, if (a) any information reasonable requested by the Promoter to deliver the prize by email is not provided to the Promoter, or (b) the Promoter has taken reasonable steps to deliver the prize by email, and is notified that the Prize could not be delivered. The Promoter is not responsible for any errors or any failure to deliver the prize to the winner that is outside their reasonable control.
    4. By entering the Promotion, entrants grant the Promoter approval to publish their name and the name of their school (if applicable) publicly as part of the prize winner announcement in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products distributed or supplied by the Promoter.

 

Draw for unclaimed prizes

    1. In the instance of any unclaimed prizes, a redraw will occur. All remaining eligible entrants will go into the draw and winners of unclaimed prizes selected at random. This will take place on Thursday 8th April 2022 at 3:00 pm AEDT at the same time and place as the original draw, subject to any directions from a regulatory authority. The winners will be notified by phone and email by Wednesday 13th April 2022.
    2. The names of the winners for the redraw will be published on the Mathletics website from Wednesday 13th April 2022 to Friday 13th May 2022.

 

Terms and Conditions

  1. The Promoter reserves the right to disqualify an entrant whose entry is not in accordance with these terms and conditions.
  2. While offering these prizes in good faith, except for any liability that cannot by law be excluded, the Promoter (including its respective officers, employees and agents) excludes all liability or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.
  3. The Promoter collects personal information (“PI”) to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at www.3plearning.com/privacy. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Privacy Policy also contains information about how entrants may opt-out, access, update or correct their PI, how entrants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All entries become the property of the Promoter.
  4. Jurisdiction of entrants: The terms and conditions of this Promotion (including the prize draw), may be withdrawn or amended for certain entrants without prior notice in circumstances the Promoter believes the Promotion or the prize draw is not able to be conducted for any reason in a particular jurisdiction or by operation of relevant law. In such circumstances the eligible entrant agrees to the amended terms and conditions, including the withdrawal of their participation in any part of the promotion (including but not limited to the prize draw). The Promoter will take reasonable steps to update these terms and conditions in those circumstances.

  6. Other Definitions: The ‘Promoter Group’ refers to the Promoter and its related companies. A reference to ‘GST’ refers to good and services tax, or sales tax that is customary in a particular jurisdiction. A reference to ‘Family Members’ includes spouse, ex-spouse, de-facto partners, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
